Does Israel follow the copyright tradition or authors' rights tradition?
Israel originally adhered to the copyright system, inherited from Britain at the end of the British Mandate. However, over the years copyright law has moved beyond its British roots, adopting on the one hand elements of American law, such as the fair use doctrine and, to a lesser degree principles of Authors' rights law. Thus, while retaining a predominantly English influence, the new Copyright Act of 2007 draws also from European sources, including the EC Information Society and Software Directives.

Does Israeli law protect unregistered trademarks?
Israeli law protects unregistered trademarks in limited cases under the law of passing off. However, the owner of an unregistered mark must prove existence of goodwill in the mark, which is not easy to prove. Unregistered well-known or famous marks are also protected, but once again there is a high hurdle to overcome to prove the fame of the mark. Furthermore, the unregistered famous mark will only be protected against use of an identical or confusingly similar mark in relation to similar goods or services.
